Withdrawal information for consumers

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period will expire fourteen days after the day on which you or a third party other than the carrier and indicated by you acquires physical possession of the goods. If you order multiple goods in a single order and they are delivered separately, the period starts when you receive the last item. If an item is delivered in several lots or pieces, the period starts when you receive the last lot or piece.

You may use the model withdrawal form below, but it is not obligatory.

You may also exercise your right of withdrawal online at https://www.solingerhandschellen.de/en/withdrawal-form using the “Withdraw from contract” function. If you use this online function, we will promptly provide an acknowledgement on a durable medium (e.g. by email) containing information about your withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (Herbert Tückmantel – Internethandel, Solinger Handschellen, Albertus-Magnus-Straße 22, c/o Förster, 42719 Solingen, Germany), without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods, including returns from outside Germany. This rule applies to withdrawal; your statutory rights in the event of defective goods or incorrect deliveries remain unaffected.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal for individually made goods

The right of withdrawal does not apply to contracts for goods that are not prefabricated and whose manufacture is determined by an individual choice or specification made by the consumer, or goods clearly personalised to the consumer’s needs (section 312g(2), no. 1 of the German Civil Code). This applies to custom products meeting these conditions; merely describing an item as “custom-made” does not by itself determine the exclusion.

Voluntary extension to 31 days

In addition to the statutory right of withdrawal, we allow consumers to withdraw from the contract up to 31 days after receipt of the goods as described above. The rules above concerning the declaration, the effects of withdrawal and the exclusion for individually made goods also apply to this voluntary extension. Your statutory rights, including a later statutory start of the period or a statutory extension of the withdrawal period, remain unaffected.
